    EMIXIR does not at any time consider an ORDER unconfirmed by S.C. ELA STAR EXIM S.R.L. as having the value of a CONTRACT.
    The notification received by the CUSTOMER, immediately after placing the ORDER, has the role of information and does not represent the confirmation of the ORDER. This notification is made electronically (e-mail) or by telephone.
    For justified reasons, S.C. ELA STAR EXIM S.R.L. reserves the right to change the quantity of PRODUCTS and / or SERVICES in the ORDER. If we change the quantity of PRODUCTS and / or SERVICES in the ORDER, we will notify the CUSTOMER at the e-mail address or telephone number provided by S.C. ELA STAR EXIM S.R.L. upon placing the ORDER and we will return the amount paid.
    The CONTRACT is considered concluded between S.C. ELA STAR EXIM S.R.L. and CUSTOMER upon receipt by CUSTOMER of S.C. ELA STAR EXIM S.R.L., by e-mail and / or SMS of the order confirmation notification. Therefore, the CONTRACT enters into force upon confirmation of the ORDER by S.C. ELA STAR EXIM S.R.L.
    The document and information provided by S.C. ELA STAR EXIM S.R.L. on the SITE will be the basis of the CONTRACT thus concluded, in their completion being the Guarantee Certificate issued by the suppliers S.C. ELA STAR EXIM S.R.L.

  2. ORDER
    The CUSTOMER / USER can place ORDERS on the SITE, by adding the desired PRODUCTS and / or SERVICES in the shopping cart, following to complete the ORDER by making the payment in one of the ways expressly indicated. Once added to the shopping cart, a PRODUCT and / or SERVICE is available for purchase to the extent that there is stock available for it. The addition of a PRODUCT / SERVICE in the shopping cart, in the absence of completion of the ORDER, does not entail the registration of the ORDER, implicitly also the automatic reservation of the PRODUCT / SERVICE.
    By completing the ORDER, the CUSTOMER agrees that all data provided by him, necessary for the online purchase process, are correct, complete and true at the date of placing the ORDER.
    By completing the ORDER, the CUSTOMER agrees that S.C. ELA STAR EXIM S.R.L. may contact him, by any means available / approved by S.C. ELA STAR EXIM S.R.L., in any situation where it is necessary to contact the CUSTOMER.
    EMIXIR may cancel the ORDER placed by the CUSTOMER, following a prior notification to the CUSTOMER, without any subsequent obligation of any party to the other or without any party being able to claim damages from the other party in the following cases:

non-acceptance by the issuing bank of the CLIENT’s card, of the Transaction, in case of online payment;
invalidation of the Transaction by the card processor approved by S.C. ELA STAR EXIM S.R.L., in case of online payment;
the data provided by the CUSTOMER on the SITE are incomplete and / or incorrect.

  1. PRICE OF GOODS AND SERVICES
    All prices related to the PRODUCTS and / or SERVICES presented on the SITE are expressed in lei (RON) and include VAT.
    Under the conditions provided by law, the price of electronic PRODUCTS displayed on the SITE, includes the Green Stamp Tax.
    In the case of online payments S.C. ELA STAR EXIM S.R.L. is not / cannot be held responsible for any other additional costs incurred by the CUSTOMER, including but not limited to currency conversion fees applied by the issuing bank of his card, if its issuance currency differs from RON. The CUSTOMER is solely responsible for this action.
    The price may be changed by S.C. ELA STAR EXIM S.R.L., at any time, without notice.
    The purchase price presented on the invoice will be the same as the one presented on the site at the time of purchase, price to which will be added the delivery costs.
    EMIXIR warns that there are cases when, due to SITE malfunctions or errors, the price displayed on the SITE may not be the actual one. In these cases, S.C. ELA STAR EXIM S.R.L. will inform the CUSTOMER on the correct price.
  2. DELIVERY METHOD
    EMIXIR will ensure the proper packaging of the PRODUCTS and will ensure the transmission of the accompanying documents.
    EMIXIR will deliver the PRODUCTS and provide the SERVICES only on the Romanian territory.
    The delivery term for the products in the store’s stock is a maximum of 6 working days, calculated from the date of taking the order. This term may be modified for reasons beyond our control.
    The day the package with your order is shipped, you will be notified by e-mail or telephone by us.
    The package can be picked up by any family member.
    IF YOU CANNOT PERFORM THE CONTRACT BECAUSE THE PRODUCT IS NOT AVAILABLE, S.C. ELA STAR EXIM S.R.L. will inform the CUSTOMER about this situation. SC ELA STAR EXIM S.R.L. may deliver to the CUSTOMER a similar PRODUCT with the same price, in case the PRODUCT initially requested is not available, only after informing and with the CUSTOMER’s consent.
    The responsibility for any damage caused to the product, package or package sent by us, rests with the courier company or the carrier according to the legislation in force. The products will be replaced by us if the courier is found guilty and we will be notified within 24 hours of receiving the package.
    The delivery details of the PRODUCTS / SERVICES including, but not limited to, the time required for delivery, do not constitute a contractual obligation on the part of S.C. ELA STAR EXIM S.R.L., without any party being able to claim damages from the other party, in case any party may be or is prejudiced in any way as a result of their violation.
  1. METHOD OF PAYMENT
    Payment for products is made with an advance payment order (O.P.), cash on delivery of the product, credit or debit card upon delivery of the product.
    The price, payment method and payment term are specified in each ORDER. SC ELA STAR EXIM S.R.L. will issue to the CUSTOMER a proforma invoice for the PRODUCTS and SERVICES to be delivered, the CUSTOMER’s obligation being to provide all the information necessary to issue the invoice in accordance with the legislation in force.
    For a correct communication of the invoice related to ORDERS, the CUSTOMER has the obligations to update whenever necessary the data from his ACCOUNT or to access the information and documents related to each ORDER, existing in the ACCOUNT.
    If a PRODUCT and / or SERVICE ordered by the CUSTOMER cannot be delivered by S.C. ELA STAR EXIM S.R.L., the latter will inform the CUSTOMER on this fact and will return to the CUSTOMER’s account the equivalent value of the PRODUCT and / or SERVICE, within a maximum of 7 (seven) days from the date on which S.C. ELA STAR EXIM S.R.L. has taken note of this fact or from the date on which the CUSTOMER has expressly expressed his intention to withdraw from the CONTRACT.
  2. TRANSFER OF OWNERSHIP OF PRODUCTS
    Unless it is agreed by S.C. ELA STAR EXIM S.R.L. and different CUSTOMER, the ownership over the PRODUCTS will be transferred upon delivery, after making the payment from the CUSTOMER in the location indicated in the ORDER (understanding by delivery – the signature of receipt of the transport document provided by the Courier.
  3. THE RIGHT OF WITHDRAWAL
    According to the Emergency Ordinance No. 34/2014 on consumer rights in contracts concluded with professionals, as well as for amending and supplementing some normative acts:
    -Before the expiration of the withdrawal period, the CUSTOMER has the right to withdraw from this contract, without having to justify the withdrawal decision and without incurring other costs than those provided in art.13 paragraph (3) and art.14 of GEO No. 34/2014, within 14 days from the day on which he enters into physical possession of the product. Return costs are borne by the CUSTOMER.
    -The returned product must be in exactly the same condition in which it was delivered (sealed, in the original packaging, with all the accessories, with the labels intact and the documents that accompanied it). Products that show physical changes, blows, shards, scratches, shocks, traces of use and / or unauthorized interventions, etc. are not accepted for return.

Reimbursement of the amount paid:
EMIXIR will reimburse the value of the product within a maximum of 14 (fourteen) days from the date of informing S.C. ELA STAR EXIM S.R.L. by the CUSTOMER on his decision to withdraw from the contract.
EMIXIR will be able to defer the refund of the value of the product until the receipt of the product sold or until receipt of proof that it has been shipped, if S.C. ELA STAR EXIM S.R.L. he did not offer to retrieve the product himself (the most recent date will be taken).

Exceptions:
The following are exempted from the right of withdrawal from the Contract:

  • the contracts for the provision of services, after the complete provision of the services, if the execution started with the prior express consent of the CUSTOMER and after he confirmed that he became aware that he will lose his right of withdrawal after the full execution of the Contract by S.C. ELA STAR EXIM S.R.L.
  • the supply of goods and / or services whose price depends on the fluctuations on the financial market on which S.C. ELA STAR EXIM S.R.L. cannot control them and which may occur during the withdrawal period;
  • the supply of Goods made according to the specifications presented by the CUSTOMER or clearly customized;
  • the supply of Goods that are likely to be damaged;
  • the supply of sealed Goods which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the CUSTOMER;
  • the supply of Goods which are, after delivery, according to their nature, inseparably mixed with other elements;
  • contracts in respect of which the CLIENT has specifically requested S.C. ELA STAR EXIM S.R.L. to travel to his home to carry out urgent repair or maintenance work.
    If, on the occasion of such a visit, S.C.ELA STAR EXIM S.R.L. provides services other than those expressly requested by the CUSTOMER or provides other Goods than the spare parts necessary for the execution of maintenance or repair work, the right of withdrawal applies to those Services or additional Goods;
  • providing sealed audio or video recordings or sealed computer programs that have been unsealed after delivery;
  • the provision of digital content that is not delivered on a material medium, if the service started with the prior express consent of the CUSTOMER and after he has confirmed that he has become aware of the fact that he will lose his right of withdrawal. These limitations are applied in accordance with GEO 34/2014 art. 16.

8. LEGAL INFORMATION
8.1. RESPONSIBILITY ISSUE
EMIXIR cannot be held liable for damages of any kind that the CUSTOMER or any third party may suffer as a result of the performance by S.C.ELA STAR EXIM S.R.L. of any of its obligations under the ORDERS and for damages resulting from the use of the PRODUCTS and SERVICES after delivery and in particular for their loss.

8.2. GUARANTEES
All PRODUCTS benefit from warranty conditions in accordance with the legislation in force and the commercial policies of the producers. The products are new (except for resealed products), in the original packaging and come from sources authorized by each manufacturer.

8.3. INTELLECTUAL PROPERTY RIGHTS
THE CONTENT, as defined in the preamble, including but not limited to logos, stylized representations, commercial symbols, still images, dynamic images, text and / or multimedia content presented on the SITE, are the exclusive property of S.C. ELA STAR EXIM S.R.L. and this, and without any implied or express warranty made by S.C.ELA STAR EXIM S.R.L. with reference to that CONTENT.
The CUSTOMER / USER may copy, transfer and / or use the CONTENT only for personal or non-commercial purposes, only if they do not conflict with the provisions of this document.
If S.C.ELA STAR EXIM S.R.L. grants the CUSTOMER / USER the right to use in the form described in a separate use agreement, a certain CONTENT, to which the CUSTOMER / USER has or obtains access as a result of this agreement, this right extends only to that or those CONTENTS defined in the agreement , only for the duration of its existence or these SITE CONTENTS or of the period defined in the agreement, under the defined conditions, if they exist and do not represent a contractual commitment ELA STAR EXIM S.R.L. for that CUSTOMER / USER or any other third party who has / obtains access to this transferred CONTENT, by any means and who may be or is harmed in any way as a result of this CONTENT, during or after the expiration of the user agreement.
No CONTENT transmitted to the CUSTOMER or USER, by any means of communication (electronic, telephone, etc.) or acquired by him by accessing, visiting and / or viewing does not constitute a contractual obligation on the part of S.C. ELA STAR EXIM S.R.L. and / or employee / superintendent S.C. ELA STAR EXIM S.R.L. which mediated the transfer of CONTENT, if any, to such CONTENT.

  1. LIMITATION OF LIABILITY FOR PRICES
